Nuway Landscape Supplies Pavers & Walls (Nuway) values and respects the privacy of the people we deal with.

Nuway is committed to protecting your privacy and complying with the Privacy Act 1988 (Cth) (Privacy Act) and other applicable privacy laws and regulations. Our privacy policy applies to any personal information we collect, use or disclose, including the personal information of our employees and contractors.

This Privacy Policy (Policy) describes how we collect, hold, use and disclose your personal information, and how we maintain the quality and security of your personal information.

What is personal information?

“Personal information” means any information or opinion, whether true or not, and whether recorded in a material form or not, about an identified individual or an individual who is reasonably identifiable. In general terms, this includes information or an opinion that personally identifies you either directly (for example, your name) or indirectly.

Information about our organisation

Nuway is a group of privately owned companies based in Brisbane and the Gold Coast, Queensland, Australia.  The primary activities of Nuway are directly related to the supply of landscaping and construction materials to the domestic end user and trade contractors (builders, landscapers, plumbers, tilers, etc.) in the construction industry.  Our focus is on bulk materials such as sands, cement, mulches, gravels and soils as well as blocks, pavers, turf and a wide range of associated materials used in the garden or in landscape construction.

How do we collect your personal information?

We collect your personal information directly from you when you:

  • Interact with us over the phone;
  • Interact with us in person;
  • Interact with us online;
  • Participate in surveys or questionnaires;
  • Attend a Nuway event;
  • Subscribe to our mailing list.

What personal information do we collect about our customers?

The personal information we collect about you depends on the nature of your dealings with us or what you choose to share with us.

You do not have to provide us with your personal information. Where possible, we will give you the option to interact with us anonymously. However, if you choose to deal with us in this way or choose not to provide us with your personal information, we may not be able to provide you with our services or otherwise interact with you.

When will your information be used?

Information volunteered by you via our contact or request for information services is only used to make contact with you.  It is securely stored on servers and shared by the Nuway General Manager only with the relevant Nuway Store which is best suited to answer your query.

Your information is never shared with third parties except where your express permission is given (for example, to exchange credit information with third parties to establish risk) or to meet legal requirements.

Typically, the information we gather when processing sales where a delivery is required or where we might reasonably be expected to need to contact you and be able to determine your identity (for example, if you purchase goods for later collection) is:

  • Contact name;
  • Business Name;
  • ABN if applicable;
  • Contact phone, fax and email;
  • Postal address;
  • Delivery address.

When hiring equipment such as trailers, wheel barrows, lawn rollers and lawn spreaders we also require information from your driver’s licence including your name, drivers licence number, date of birth and licence expiry date.  This information is securely stored within the store with which you are dealing and is used to ensure any traffic violation penalties incurred while using our trailer can be forwarded to the driver and also to ensure we can track down missing or stolen equipment.  It is not shared with any third parties except where required by police or statutory authorities to further criminal investigations or to provide information which identifies the driver if, for instance, a speeding infringement has been issued.

When establishing whether or not a trade discount should be offered to customers claiming their business is directly related to the landscaping industry and therefore offers an opportunity to present repeat business to us, we will either ask for your ABN to prove you do actually run a business, to ensure it is currently registered for GST and to check that your primary business focus is associated with the landscaping industry.  We may also use government websites such as ASIC or ABN Lookup (www.abr.business.gov.au) to find publicly listed information such as your ABN, registered business name, whether or not your business is currently registered for GST and the postcode of the suburb in which your business is currently registered.

When collecting information required for the purpose of determining whether or not a credit account should be established or continued with you or your business, we will ask for your permission to share the information with third parties. This is to establish risk based on your credit history.

When you have given your express permission, Nuway will use your contact details to send relevant information to your postal address or email address for the purposes of informing you of our sales and marketing activities, catalogues, specials and other matters which may be of interest to you.  Nuway does not use this information for any other purposes and does not share it with any third parties without your express permission.  To opt out of Nuway mailing lists you may:

  • Contact the store or stores with which you normally deal or email us at [email protected];
  • Follow the instructions to “unsubscribe'' set out in the relevant communication; or
  • Contact [email protected].

How will your information be stored and secure?

We have implemented security policies, rules and technical measures to protect the personal data that we have under our control from:

  • Unauthorised access;
  • Improper use or disclosure;
  • Unauthorised modification;
  • Unlawful destruction or accidental loss.

Nuway will take reasonable steps to ensure that the personal information that we hold about you is kept confidential and secure, including by:

Having a robust physical security of our premises and databases / records;

  • Taking measures to restrict access to only personnel who need that personal information to effectively provide services to you;
  • Having technological measures in place (for example, anti-virus software, fire walls);
  • Archiving and destroying inactive records.

All our employees and data processors, who have access to, and are associated with the processing of personal data, are obliged to respect the confidentiality of our visitors’ personal data. We ensure that your personal data will not be disclosed to State institutions and authorities except if required by law or other regulation.

Retention of personal information

We will not keep your personal information for longer than we need to. In most cases, this means that we will only retain your personal information for the duration of your relationship with us unless we are required to retain your personal information to comply with applicable laws, for example record-keeping obligations.

How to access and correct your personal information

Nuway will endeavour to keep your personal information accurate, complete and up to date.

If you wish to make a request to access and/or correct the personal information we hold about you, you should make a request by contacting us in writing to [email protected] and we will respond within seven (7) days. We will require you to establish your identity by proving your identity before any personal information is revealed. 

We will provide you with a readable copy of the personal data which we keep about you within seven (7) days. We allow you to challenge the data that we hold about you and, where appropriate, you may have the data:

  • Erased;
  • Rectified or amended; and
  • Completed.

We reserve the right to refuse to provide our visitors and employees with a copy of their personal data, but will give reasons for our refusal.

What personal information do we collect on our website and social media pages?

Data is collected by Nuway in the following ways from the Nuway website and third-party social media services:

  • Volunteered by each visitor;
  • Cookies; 
  • Website analytics.

We may collect your personal information from the Nuway Website, third parties or through publicly available sources, for example, via social media services. This information is collected for the following uses:

  • Improving customer experience;
  • Website specials; and

If you access a third-party website through our website(s), personal information may be collected by that third party website. We make no representations or warranties in relation to the privacy practices of any third-party provider or website and we are not responsible for the privacy policies or the content of any third-party provider or website. Third party providers / websites are responsible for informing you about their own privacy practices and we encourage you to read their privacy policies.

Inquiries and complaints

For complaints about how Nuway processes or manages your personal information, please contact [email protected] . Note we may require proof of your identity and full details of your request before we can process your complaint.

Please allow up to seven (7) days for Nuway to respond to your complaint. It will not always be possible to resolve a complaint to everyone’s satisfaction. If you are not satisfied with Nuway’s response to a complaint, you have the right to contact the Office of Australian Information Commissioner (at www.oaic.gov.au) to lodge a complaint.
